The San Marcos Police Department responded to an incident downtown Oct. 27, resulting in the arrests of two men.
Mekhi Arthur Burgess, 22, was arrested for aggravated assault with a deadly weapon, tampering with physical evidence and possession of a controlled substance.
At about 11:47 p.m., SMPD officers were dispatched to Mayloo’s, 138 N. LBJ Dr., in response to a verbal disturbance. Callers reported four males were kicked out of the bar due to their intoxication levels, and one of the males brandished a gun at the door staff.
When officers arrived, three of the suspects were located. Police say the suspects “made furtive movements to their pockets and waistbands which resulted in them being held at gunpoint.” Police say when officers commanded suspect Burgess to put his hands in the air, he removed a gun from his waistband in an attempt to put it on the ground.
The three individuals were taken into custody. Burgess was in a group with Clayton Edward Grumbles, 21, who was arrested for public intoxication. A third male was released at the scene after police determined he had nothing to do with the disturbance. Officers determined that Burgess was the male that brandished the firearm at the door staff. The fourth member of their group was not located.
At the scene, officers say they located a handgun and a small bag containing pills, which Burgess attempted to dump under a car. As of Oct. 30, Burgess is being held in the Hays County Jail with a bond of $29,000. Grumbles was released without bail.
